[Esip-preserve] draft ESIP Data Policy

The term "freely" used in the paragraph on Types I and II is somewhat ambiguous due to the two meanings it can carry (1. unfettered and 2. zero cost).  Also, replacing the phrase "at no more than the cost of reproduction for research and education" with "at no more than the cost of fulfilling the user's request" would make it consistent with the OMB policy. This policy is mandatory for Types I and II (that are funded by federal government), but optional for Type III's that are commercial entities. I believe what we are trying to do here is find out (through feedback from the Type III's) if the federation can set policy that applies the OMB policy to the participating commercial entities as well.

Ruth -

While in many situations, protections for human subjects or for other 
concerns, such as endangered species or critical infrastructure, etc., 
might be covered by law or legal agreement, we cannot assume that is 
always the case, so we might want to add a clause, that alludes to other 
restrictions as exceptions.
