I am actually in favor of the recommendation.  We would *like* to be able to distribute source code without fear of legal repercussions.  (It's not a matter of choice.)

Actually, I don't quite agree with this, there is a potential effect on the second set: the recommendation could be used to help the push for changes to release policies or procedures.
